When they use these merit-based instruments, they may find themselves the subject of costly lawsuits and find that such tests may indeed be found discriminatory under Constitutional law and legislative and regulatory pronouncements. They may then be compelled to come up with studies proving that their merit standards are 'demonstrably related' to job performance and are a 'business necessity.' Some businesses avoid government obtrusion and legal troubles by implementing policies aimed at ensuring minority representation. Companies that want to benefit from productivity gains that merit-based tests usually produce should be brave enough to defend themselves before the courts.
